FOGO Rewards Terms of Use

By participating in the FOGO Rewards program, you agree to be bound by these terms of use and all terms incorporated by reference. If you do not agree to these terms, do not participate in the FOGO Rewards program.

The Program and these terms and conditions are governed by the Laws of the State of Florida without regard to principles of conflicts of laws. The FOGO Rewards Program, and all Fogo Points and rewards, are void where restricted or prohibited by law.

These Terms of Use apply to your access to, and participation in, the FOGO Rewards program (hereinafter referred to as “Fogo Rewards”) which is operated by Susshi International Inc. (hereinafter referred to as “the Company”). These Terms of Use do not alter in any way the terms or conditions of any other agreement you may have with the Company for other products and services. Any changes or modifications will be effective immediately upon posting the revisions to www.fogocharcoal.com and you waive any right you may have to receive specific notice of such changes or modifications. Your participation in Fogo Rewards confirms your acceptance of these Terms of Use and any such changes or modifications; therefore, you should review these Terms of Use and applicable policies frequently to understand the terms and conditions that apply to Fogo Rewards.

The Fogo Rewards program is intended for personal use only, Commercial use is prohibited. You must be at least 18 years old to be able to participate and join the Fogo Rewards program.

Fogo Rewards is one way in which the Company endeavors to reward and thank loyal customers. Members of Fogo Rewards are able to earn and accumulate “Fogo points” that can be redeemed for Fogo Rewards benefits, also known as “Rewards” in our online store. Exclusive items offered as Rewards for your Fogo Points may only be available for members of the Fogo Rewards program.

Joining Fogo Rewards

There are two ways to enroll in Fogo Rewards and begin accumulating Fogo points:

1. Visit www.fogocharcoal.com/rewards. Follow the prompts to create a Fogo account.
2. Purchasing any product at www.fogocharcoal.com and creating an account while checkout will automatically create you a Fogo Rewards account.

The registration process requires that you provide the following information: email address, password and marketing preferences.

Earning Fogo Points

The benefits or prizes that are available to you through Fogo Rewards are based on the number of “Fogo Points” that you earn. You can earn Fogo Points by making purchases in www.fogocharcoal.com or other activities detailed in www.fogocharcoal.com/rewards.

You will earn Fogo points based on the value of your purchase at the rate of ten (10) Fogo Points for each one dollar ($1.00) you spend. Fogo Points cannot be earned on non-merchandise items, such as shipping gift wrap, and gift cards. Points are earned on the net purchase amount after applying all discounts, offers, coupons, and rewards redemptions. Generally, Fogo Points for qualifying purchases are automatically added to your account, unless there is a technical problem that may cause delays. From time to time, we, or others acting with our permission, may offer you special promotions that offer you “Promotional Fogo Points”. Promotional Fogo Points, such as “bonus” points, will be awarded as described in the applicable promotional offer and will be subject to any additional terms set forth in the promotional offer.

If you void a purchase made with your registered Fogo Account, the Company will deduct the Fogo Points that you were awarded for that purchase.

Purchases that have any other special discount/wholesale prices, are intended for Resale,  or are shipped orders outside of the United States, are ineligible to participate in Fogo Rewards and will not accumulate any Fogo Points.

Miscellaneous

There are no membership fees associated with Fogo Rewards. Fogo Points accumulated under the program are promotional and have no cash value.

Your Fogo Points, Rewards, and your account under the Fogo Rewards are personal to you and may not be sold, transferred or assigned to, or shared with, family, friends or others, or used by you for any commercial purpose. You may have only one (1) Fogo Rewards account that is personal to you.

Without notice to you, the Company reserves the right to suspend any Fogo Account and/or terminate your account and/or your participation in Fogo Rewards if the Company determines in its sole discretion that you have violated these Terms of Use, you have more than one (1) account, or that the use of your account is unauthorized, deceptive, fraudulent, or otherwise unlawful. The Company reserves the right to take legal action to recover any damages, attorneys’ fees, or court costs from you. The Company may, in its sole, discretion, suspend, cancel or combine accounts that appear to be duplicative. In the event that your participation in Fogo Rewards is terminated, then all accumulated Fogo Points in your account are void.

Without notice to you, if your account has been inactive for a consecutive period of twelve(12) months, Fogo Points will expire immediately, and the Company reserves the right to “unregister” your account. Inactivity is defined as no new purchases or Fogo Points redemptions made. In the event that your Fogo Account is unregistered or rendered inactive, then all accumulated Fogo Points in your account are void.

The Company reserves the right to interpret and apply the Fogo Rewards terms and conditions at its sole discretion, subject to applicable law. All interpretations by the Company are final. By participating in Fogo Rewards, you hereby release the Company from and against any and all claims, damages, losses, liabilities, and other expenses (including, without limitation, attorney’s fees) relating to your participation in Fogo Rewards, use of Fogo Points, or agreement to these terms and conditions.

The Company reserves the right to terminate, discontinue or cancel the Fogo Rewards program at any time and in its sole discretion without notice to you. If the Fogo Rewards program is terminated, discontinued or canceled, all Fogo points are void.
